Martijn Nouwen mag dan een integere onderzoeker zijn \u2013 en ik geloof hem, maar mij bekruipt het gevoel, dat hij ook aan zijn carri\u00e8reweg timmert. Niks mis mee, maar daarmee kan een kleuring aan zijn werk worden meegegeven, die tegen de grens van sensatie aanschuurt. Dat hij via NRC eerder en ook via de rechter druk heeft moeten uitoefenen om publicatie van zogeheten kennisgroepstandpunten van de Belastingdienst te versnellen, rechtvaardigt volgens hem de conclusie, dat de top van de Belastingdienst weigert open te zijn over standpunten van haar 26 vaktechnische denktanks (NRC 29\/3\/2023). <\/p>\n\n\n\n

Martijn Nouwen may be an honest researcher \u2013 and I believe him, but I get the feeling that he is also working on his career path. Nothing wrong with that, but this can give a coloring to his work that rubs against the border of sensation. The fact that he had previously had to exert pressure via NRC and also through the courts to speed up the publication of so-called knowledge group positions of the Tax and Customs Administration, justifies the conclusion that the top of the Tax and Customs Administration refuses to be open about the positions of its 26 technical think tanks (NRC). 3\/29\/2023).<\/p>\n\n\n\n

Ik denk niet, dat die conclusie terecht is. Nouwen zegt: \u201eDe politieke top frustreert openbaarmaking, het staat er letterlijk\u201d. Hij wijst daarbij met name op een uitlating van een kennisgroep voorzitter in een jaarverslag: \u201eDe afweging van uitstralingseffecten, politieke aspecten en mogelijke Europeesrechtelijke implicaties zorgen hierbij echter voor vertraging.\u201d Naar mijn mening wordt hier bedoeld de vertraging in de afdoening van het antwoord door de kennisgroep aan de inspecteur. De vragende burger wacht namelijk met smart op antwoord. NB: er is dus nog geen standpunt bekend. Ook niet bij de kennisgroep. Er wordt niemand voorgetrokken.
Terecht wijst Nouwen op het gevaar van staatssteun. Een oude goedkeuring voor een gunstige toepassing van een wetsartikel kan nu door Europese ontwikkelingen een verboden staatssteun opleveren. En ja, wellicht zijn er burgers die na publicatie daar geen boodschap aan hebben. Claims zullen echter altijd door de rechter worden afgewezen. Maar de burger eist wel, dat de beleidsmaker rechtsstatelijk met publicatie van die oude standpunten omgaat. Dus zorgvuldig. En dat doet de beleidsmaker.
Het is goed, dat Martijn Nouwen tenslotte 3 voorbeelden van standpunten geeft. Omdat met deze standpunten duidelijk wordt gemaakt, dat alle feiten en omstandigheden ertoe doen. Bij het ontbreken ervan \u2013 en daar lijkt het op \u2013 kan het antwoord niet zomaar voor alle burgers van toepassing zijn. In dit tijdsgewricht wordt van de inspecteur ge\u00ebist, dat hij niet zo star moet zijn en waar het kan maatwerk moet verrichten. En desgevraagd helpt de kennisgroep daarbij. De voorbeelden zijn geen rechtsvragen, maar feitelijke vragen die een individueel geval betreffen. Mijn voorspelling is, dat dit soort vragen niet meer aan een kennisgroep worden voorgelegd, maar in de beslotenheid van de relatie tussen belastinginspecteur en burger zullen worden beantwoord.
Laat ik met Martijn Nouwen meegaan, dat hij een waardevol initiatief heeft ondernomen. Maar zijn onterechte slechte pers in het NRC helpt niet om het vertrouwen in de overheid te herstellen.<\/p>\n\n\n\n

I don’t think that conclusion is correct. Nouwen says: \u201cThe political top frustrates disclosure, it is literally there\u201d. He refers in particular to a statement made by a knowledge group chairman in an annual report: “However, weighing up the impact of spillover effects, political aspects and possible European legal implications causes delays.” In my opinion, what is meant here is the delay in the processing of the answer by the knowledge group to the inspector. The questioning citizen waits anxiously for an answer. NB: no position has yet been announced. Not even in the knowledge group. No one is favored.
Nouwen rightly points out the danger of state aid. An old approval for a favorable application of a legal article can now result in prohibited state aid due to European developments. And yes, there may be citizens who do not care after publication. However, claims will always be rejected by the court. But the citizen does demand that the policymaker treats the publication of those old positions in a constitutional manner. So carefully. And that is what the policy maker does.
It is good that Martijn Nouwen finally gives 3 examples of points of view. Because these views make it clear that all facts and circumstances matter. In the absence of it \u2013 and it seems \u2013 the answer cannot simply apply to all citizens. At this juncture, the inspector is required not to be so rigid and, where possible, to do custom work. And if requested, the knowledge group will help with this. The examples are not questions of law, but factual questions concerning an individual case. My prediction is that these kinds of questions will no longer be submitted to a knowledge group, but will be answered in the privacy of the relationship between tax inspector and citizen.
Let me agree with Martijn Nouwen that he has taken a valuable initiative. But his unjustified bad press in the NRC does not help to restore confidence in the government.<\/p>\n\n\n\n
