Natuurlijk, alle superlatieven over dit vreselijke bijtincident met de herdershond van opa en oma, die hun 8 maanden oude kleinzoon dodelijk heeft verwond, zijn gezegd. Niet in het minst, dat de moeder van de baby opa en oma aanklaagt voor dood door schuld. Maatschappelijke schuld is volgens de rechtbank nog iets anders is dan juridische schuld. En dat laatste is er niet oordeelt de rechtbank in twee uitspraken: het gedrag van de herdershond was niet voorzienbaar. Toch schuurt er iets aan dat oordeel.<\/p>\n\n\n\n

Oma heeft de baby \u2013 die kennelijk tijdens die oppas voor het eerst kon staan \u2013 tegen de tafel aan gezet en is naar de keuken gegaan. Opa stond kort bij de baby, maar niet tussen de baby en de hond. De hond tot dan op enkele meters gelegen heeft toen binnen enkele seconden dodelijk toegeslagen. Kennelijk heeft de hond bij eerdere oppasgelegenheden geen tekenen van agressie vertoont. De rechtbank heeft de relatie tussen de hond en de eigenaren en de verklaring van de deskundige zo opgevat, dat \u201cop basis van de regels die gelden in het maatschappelijk verkeer kan niet vastgesteld worden dat verdachte en [medeverdachte] voorzichtiger of oplettender hadden moeten zijn\u201d Maar er was wel een nieuwe situatie: de baby kon voor het eerst rechtop staan. Ook nieuw voor de op het oog goedaardige herdershond. De deskundige geeft daarvoor een waarschuwing, waaraan de rechter volgens mij meer gewicht had moeten geven: \u201cIn zijn algemeenheid kunnen in het geval van een Duitse herdershond de eigenschappen van sterke neiging tot najagen en verdedigen de hond minder geschikt maken voor het samenleven met andere huisdieren en kinderen, inclusief baby\u2019s.\u201d En voorts: \u201cDe deskundige heeft ter terechtzitting desgevraagd verklaard dat zij adviseert om een hond nooit alleen te laten met een kind, dat een kind en een hond geen fijne combinatie is, alhoewel dat wel het algemene gevoel is in de maatschappij. In het geval dat een hond in dezelfde ruimte is als een kind, dan moet volgens haar – zoals gerapporteerd – het gedrag van zowel de hond, als het kind in de gaten worden gehouden. Het is niet voldoende om te weten waar de hond is, maar belangrijk is te weten wat hij doet. Volgens haar is dit ook het advies van het Landelijk Informatiecentrum Gezelschapsdieren (LICG).\u201d Nu de baby voor de eerste keer stond, konden opa en oma niet weten wat de hond zou doen. Dus mogelijk wel voorzienbaar.<\/p>\n\n\n\n

Een pitbull terri\u00ebr is ook een ras \u201cmet de eigenschappen van sterke neiging tot najagen en verdedigen\u201d. Van dat ras is bekend, dat zij tot op zekere hoogte ook kindvriendelijk kunnen zijn, maar dat hun bijtinstinct onvoorzienbaar kan opspelen. Is de herder niet met dit ras te vergelijken? En had dus de herdershond niet op zichzelf, maar afgezet tegen andere hondenrassen met een bijtinstinct moeten worden beoordeeld? Overigens hoop ik, dat de hond niet is gestraft.<\/p>\n\n\n\n

Of course, all the superlatives have been said about this terrible biting incident involving grandma and grandpa’s sheepdog, which fatally injured their 8-month-old grandson. Not least, that the baby’s mother is suing grandparents for culpable homicide. According to the court, social debt is something different from legal debt. And the latter is not the case, the court ruled in two rulings: the behavior of the sheepdog was not foreseeable. Yet there is something off about that judgement. Grandma put the baby \u2013 who was apparently able to stand for the first time during that babysitting \u2013 against the table and went to the kitchen. Grandpa stood close to the baby, but not between the baby and the dog. The dog, which had been a few meters away until then, struck fatally within a few seconds. Apparently the dog has not shown any signs of aggression on previous babysitting occasions. The court interpreted the relationship between the dog and the owners and the expert’s statement in such a way that “on the basis of the rules that apply in society, it cannot be determined that the suspect and [co-suspect] should have been more careful or attentive” But there was a new situation: the baby could stand upright for the first time. Also new for the apparently good-natured sheepdog. The expert gives a warning about this, which I think the judge should have given more weight to: “In general, in the case of a German shepherd dog, the characteristics of a strong tendency to chase and defend can make the dog less suitable for living together with other pets.” and children, including infants.\u201d And furthermore: \u201cWhen asked at the hearing, the expert stated that she advises never leaving a dog alone with a child, that a child and a dog is not a nice combination, although that is the general feeling in society. In the event that a dog is in the same room as a child, she says – as reported – the behavior of both the dog and the child should be monitored.<\/p>\n\n\n\n

It is not enough to know where the dog is, but it is important to know what he is doing. According to her, this is also the advice of the National Information Center for Companion Animals (LICG).\u201d Now that the baby was standing for the first time, Grandma and Grandpa couldn’t have known what the dog would do. So possibly foreseeable. A pit bull terrier is also a breed \u201cwith the characteristics of a strong tendency to chase and defend\u201d. It is known that this breed can also be child-friendly to a certain extent, but that their biting instinct can arise unpredictably. Can’t the shepherd be compared to this breed? And should the sheepdog not have been assessed on its own, but compared to other dog breeds with a biting instinct? By the way, I hope that the dog has not been punished.<\/p>\n\n\n\n
