Musk now as head DOGE: Illegal appointment?<\/p>\n\n\n\n

Veel ingezonden brieven over Elon Musk (NRC 25\/1\/25 Inbox van de redactie). Maar waar gaat het mis bij de invloed die techmiljardairs willen kopen, bijvoorbeeld met een donatie van 250 miljoen dollar aan Trumps campagne? Zulke giften in de VS zijn niet fiscaal aftrekbaar. Dan kan het een ander doel dienen: deze donatie is eigenlijk een investering in een politieke functie.<\/p>\n\n\n\n

Volgens de Amerikaanse wet mogen politieke donaties niet direct gekoppeld worden aan benoemingen. Toch lijkt Musk\u2019s benoeming als hoofd van het Department of Government Efficiency (DOGE) het gevolg van zijn royale steun (waarschijnlijk via de strikt gereguleerde zgn. SuperPACs). Trump zal natuurlijk niet toegeven, dat er een verband is.<\/p>\n\n\n\n

De fiscale wet kent het principe van \u201csubstance over form\u201d \u2013 de werkelijke intentie achter een transactie telt zwaarder dan de manier, waarop het op papier wordt gepresenteerd. Als de donatie van Musk werkelijk gezien moet worden als een investering in een politieke positie, kan de benoeming illegaal zijn. Aan het eind van president Trump\u2019s laatste termijn kan dat gevoegd worden aan de lange lijst van rechtszaken. Mocht het ooit zover komen.<\/p>\n\n\n\n
