De eenmansfractie Omzigt wijdt er een âonelinerâ aan: âde kamervoorzitter is geen procesbegeleider, maar scheidsrechterâ. En dat is interessant. Pieter Omzigt lijkt daarmee een tegenstelling uit te drukken.
Commotion in the chicken coop of the House of Representatives during the discussion of Rutte IV’s coalition statement. Chamber president Vera Bergkamp is accused of not acting adequately against the hurtful remarks made by Geert Wilders (NRC 19/1/22) towards members of the House of Representatives.
The one-man faction Omzigt devotes a ‘one-liner’ to it: “the chamber chairman is not a process supervisor, but a referee”. And that’s interesting. Pieter Omzigt thus seems to express a contradiction.
Maar dat is niet terecht. Een scheidsrechter is een procesbegeleider en omgekeerd. Dat wordt eigenlijk ook in het reglement van orde van de Tweede Kamer geregeld.
But that’s not right. A referee is a process facilitator and vice versa. This is actually also regulated in the Rules of Procedure of the House of Representatives.

In art 3.2 van het reglement van orde van de Tweede kamer staat, dat de voorzitter de werkzaamheden van de Kamer leidt Ă©n toeziet op naleving van het reglement van orde.
Article 3.2 of the Rules of Procedure of the House of Representatives states that the President directs the work of the House and monitors compliance with the Rules of Procedure.
En ja, de kamervoorzitter kan op grond van art 8.16 ingrijpen, als de spreker zich niet onthoudt van het gebruik van beledigende uitdrukkingen; en ook op grond van art 8.17 het woord ontnemen bij weigering de beledigende woorden terug te nemen. Maar net als voetbalscheidsrechter Bas Nijhuis als slogan heeft âniet zeiken, voetballen!â, heeft Vera Bergkamp terecht niet ingegrepen. Het is aan de kamerleden zelf elkaar aan te spreken op het gedrag. Nu nog via de voorzitter, maar steeds meer direct. Zeker als blijkt, dat de spreker zich niet aan het reglement van orde gebonden voelt. Immers, Wilders trekt zijn woorden niet in. Eerder voeren andere leden ook scherp aan de wind. Het (aangepaste) reglement staat of valt met acceptatie van alle leden. Het komende kamerdebat daarover voorspelt niet veel goeds.
And yes, the chamber president can intervene on the basis of art 8.16, if the speaker does not refrain from using insulting expressions; and also on the grounds of art 8.17 deprivation of the floor in the event of refusal to take back the insulting words. But just as football referee Bas Nijhuis has the slogan ‘don’t whine, play football!’, Vera Bergkamp rightly did not intervene. It is up to the members of parliament to hold each other accountable for their behaviour. Now still through the chairman, but increasingly directly. Certainly if it turns out that the speaker does not feel bound by the rules of procedure. After all, Wilders does not retract his words. Earlier, other members also sailed close to the wind. The (adjusted) regulations stand or fall with the acceptance of all members. The forthcoming parliamentary debate on this does not bode well.
