Is reconstruction of Ukraine now possible with Russian money?
De vraag is of het creatieve idee van de advocaten Tobias Cohen Jehoram en Eelco Meerdink (NRC 20/5/22) voldoende opbrengt voor de wederopbouw van Oekraïne. Het is de dominee die tegen de koopman opbiedt. Een wet (de dominee) die de zgn. staatsimmuniteit van misdadige regimes, zoals Rusland, opheft en die het mogelijk maakt het bevroren bezit in NL afhandig te maken door private schuldeisers tegen betaling van een provisie (de koopman) voor het goede doel. In dit geval is het goede doel de wederopbouw van Oekraïne. Ik neem aan, dat president Poetin ook onder de staat Rusland wordt verstaan. Een staat bestaat immers uit haar instituties. Dan zou je wellicht ook de leden van het parlement mee moeten nemen.

De bedenkers van dit idee vegen de bezittingen van Wit-Rusland en de oligarchen wel op een hoop alsof deze het eigendom zijn van de staat Rusland. Dat is natuurlijk niet zo. Weliswaar zijn de oligarchen de financiële steunpilaren van het regime van Rusland, maar zij zijn niet de staat Rusland. Wit-Rusland die de inval van Rusland faciliteerde heeft zich niet schuldig gemaakt aan “genocide, staatsterrorisme, oorlogsmisdaden of misdaden tegen de menselijkheid”. Die staat behoudt ook haar immuniteit. Er lijkt niet veel over te blijven voor de provisie voor Oekraïne na aftrek van de tegoeden van de oligarchen en Wit-Rusland.
The originators of this idea do lump together the assets of Belarus and the oligarchs as if they were the property of the state of Russia. That is of course not the case. It is true that the oligarchs are the financial pillars of the regime of Russia, but they are not the state of Russia. Belarus, which facilitated Russia’s invasion, has not committed “genocide, state terrorism, war crimes or crimes against humanity”. That state also retains its immunity. There doesn’t seem to be much left for the provision for Ukraine after deducting the assets of the oligarchs and Belarus.
