Het is maar goed, dat een uitspraak van het Internationaal Gerechtshof in het Vredespaleis over de aanklacht van Zuid-Afrika, dat Israël genocide pleegt op de Palestijnse bevolking in Gaza, nog jaren op zich laat wachten (NRC 13/14 jan 2024 Israël voelt zich ‘gedemoniseerd’ in genocide-zaak). Een uitspraak op korte termijn zal alleen maar olie op het vuur gooien.
Als er sprake is van genocide, zal het anti Israëlische sentiment toenemen. De Westerse steun aan Israël staat onder druk, als Israël zich niet bij dat oordeel neerlegt. En dat laatste lijkt niet onwaarschijnlijk. Immers, de reputatie en geloofwaardigheid van bijv. Nederland staat dan op het spel; daar waar de stad van Vrede en Gerechtigdheid is gevestigd. Nederland laadt anders de verdenking op zich het koloniale gedachtegoed nog steeds te ondersteunen. In de Nederlandse straten zal de spanning toenemen.
Als er geen sprake is van genocide, zal daarmee het anti Israëlische sentiment ook toenemen. Immers, het recht heeft niet gezegevierd. Zuid-Afrika zal daarin het bewijs zien, dat het Westerse kolonialisme springlevend is en nu zelfs door het Vredespaleis ondersteund. Ook hierdoor zal de spanning in de Nederlandse straten toenemen.
Linksom of rechtsom, een uitspraak op korte termijn is niet wenselijk. Wel is het Vredespaleis een arena voor de wereld, waar partijen in woorden elkaar kunnen bevechten over wat de waarheid is. Dat is de toegevoegde waarde van deze juridische strijd. Maar achter de schermen moet onverminderd hard gewerkt worden aan het overtuigen van de Israëlische regering én de leiding van Hamas, dat de ingeslagen weg een heilloze is. Zonder gezichtsverlies. Dat is de meest effectieve weg uit dit drama.
It is a good thing that a ruling by the International Court of Justice in the Peace Palace on South Africa’s accusation that Israel is committing genocide against the Palestinian population in Gaza is still years away (NRC 13/14 Jan 2024 Israel feels ‘demonized’ in genocide case). A short-term ruling will only add fuel to the fire.
If there is genocide, anti-Israeli sentiment will increase. Western support for Israel is under pressure if Israel does not accept that judgment. And the latter does not seem unlikely. After all, the reputation and credibility of, for example, the Netherlands is at stake; where the city of Peace and Justice is located. Otherwise, the Netherlands would be suspected of still supporting colonial ideas. Tension will increase in the Dutch streets.
If there is no genocide, anti-Israeli sentiment will also increase. After all, justice has not prevailed. South Africa will see this as proof that Western colonialism is alive and well and is now even supported by the Peace Palace. This will also increase the tension in the Dutch streets.
Left or right, a decision in the short term is not desirable. However, the Peace Palace is an arena for the world, where parties can fight each other in words about what the truth is. That is the added value of this legal battle. But behind the scenes, hard work must continue to convince the Israeli government and the leadership of Hamas that the chosen path is a disastrous one. Without losing face. That is the most effective way out of this drama.
